Terms of Service

By downloading, installing, or using the Muddle & Fry application ("the App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

These Terms apply to all users of the App, including visitors, registered users, and venue contributors.

The App is licensed to you, not sold. SMCS Investments Inc. grants you a personal, non-transferable, non-exclusive license to use the App on Apple-branded or Android devices that you own or control, solely for your personal, non-commercial use.

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, disassemble, or attempt to derive the source code of the App
• Distribute, sublicense, or make the App available over a network for use by multiple devices simultaneously
• Transfer or sell your license to any third party
• Use automated scripts or bots to interact with the App

Muddle & Fry is an app designed around the culture of Supper Clubs and Dive Bars — establishments that serve alcohol. By using the App, you confirm that you are of legal drinking age in your jurisdiction (21 years of age in the United States).

We reserve the right to terminate accounts of users who misrepresent their age.

You agree to use Muddle & Fry only for its intended purpose — discovering and celebrating Midwest Supper Club and Dive Bar culture. You agree not to:

• Submit false, inaccurate, or misleading venue check-ins or reviews
• Attempt to manipulate the badge or Regular status systems through fraudulent activity
• Use the App in any way that violates applicable local, state, or federal laws
• Use the App to harass, abuse, stalk, threaten, or defame any person or entity

Badges, Regular status, passport stamps, and other in-app achievements are virtual items with no real-world monetary value. They are non-transferable, non-refundable, and may be modified or removed at our discretion.

Digital goods purchased through Apple In-App Purchase are subject to Apple's Terms of Sale. Digital goods purchased through Google Play are subject to Google Play's Terms of Service. Physical goods purchased through the App are processed via Stripe and are subject to separate purchase terms provided at checkout.

You are responsible for maintaining the security of your account credentials. Muddle & Fry is not liable for any loss or damage arising from unauthorized access to your account.

You may delete your account at any time. Please refer to our Privacy Policy for details on the data deletion process.

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.

Muddle & Fry strives to keep venue information accurate and up to date, but we make no guarantees regarding the accuracy, completeness, or current status of any venue listed on The Trail. Hours, menus, and availability are subject to change. Always confirm details directly with the venue before visiting.

The App may enable access to third-party services including Google Maps, Firebase, and Google Sign-In (collectively, "External Services"). You agree to use External Services at your sole risk. SMCS Investments Inc. is not responsible for the content, accuracy, or availability of any External Services and shall not be liable for any such services.

SMCS Investments Inc. reserves the right to change, suspend, or remove access to any External Services at any time without notice or liability.

You agree that SMCS Investments Inc. may collect and use technical data about your device, system software, and application usage to facilitate software updates, product support, and service improvements. This information is used only in forms that do not personally identify you. See our Privacy Policy for full details.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ANY SERVICES PROVIDED BY THE APP ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. SMCS INVESTMENTS INC. HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE APP AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY SMCS INVESTMENTS INC. OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY.

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL SMCS INVESTMENTS INC. BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF SMCS INVESTMENTS INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL SMCS INVESTMENTS INC.'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED FIFTY DOLLARS ($50.00).

You may not use or export the App in violation of United States export laws and regulations. By using the App, you represent and warrant that you are not located in a country subject to a U.S. Government embargo and that you are not on any U.S. Government restricted-party list, including the Treasury Department's Specially Designated Nationals List or the Commerce Department's Denied Persons List.

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions.

We reserve the right to update these Terms at any time. Changes will be reflected by an updated "Last Updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
